1. What these terms cover

These Website Terms of Use govern your use of samadhansarathi.com (the "website"). They apply to everyone who visits the site, whether or not you go on to become a client.

They cover the website itself — reading it, the material on it, and how it may and may not be used. They are separate from the terms that govern our services:

• Terms & Conditions for case submission — when you send us a case for review under Bima Samadhan.
• DraftKit service terms and DraftKit payment and refund policy — for DraftKit, our document service.
• Privacy Policy — what we do with personal data.

Where those pages deal with a subject specifically, they take precedence over these general terms. Once a written Service Agreement is signed for a case, that agreement governs the case.

By using this website you accept these terms. If you do not accept them, please do not use the website.

2. About us, and what this website is not

This website is published by Samadhan Sarathi, whose details are set out at the end of this page. We provide two services: Bima Samadhan, full grievance and dispute case handling, and DraftKit, documents we draft for you to file yourself.

We are not an insurer, not a law firm, and not connected to, affiliated with or endorsed by any Government authority or regulator.

Nothing on this website is legal, financial or insurance advice. The pages here describe procedures in general terms, for general readers. Your own matter turns on its own facts, documents and dates. Do not act or refrain from acting on the strength of something you read here without getting advice on your actual case — from us or from someone else.

Reading this website, sending us an enquiry, or submitting a case for review does not by itself create a professional relationship between us. That begins only when we have accepted your case in writing.

3. Who may use this website

You may use this website if you are 18 or over and legally able to enter into a contract in India. If you are under 18, please use it only with the involvement of a parent or guardian, and do not send us personal information without their consent.

You may use the website from outside India, but it is written for readers in India and describes Indian grievance procedures. We make no claim that the content is appropriate or available for use anywhere else.

You are responsible for your own internet access, device and data charges, and for making sure that anyone who reaches this website through your connection or device is aware of these terms and complies with them.

4. What you may do with the material on this website

The text, page design, layout, graphics, illustrations, icons, photographs, structured data and code on this website belong to Samadhan Sarathi or are used by us under licence. So do the names Samadhan Sarathi, Bima Samadhan and DraftKit, and the logo.

You may read the website, and print or download extracts, for your own personal or internal use. You may quote a short passage, or link to any page, provided you identify us as the source and do not suggest we endorse you or your material.

You may not, without our written permission:

• republish, sell, rent, sub-licence or commercially exploit material from this website;
• copy the website or a substantial part of it, or produce a derivative version of it;
• present our pages inside a frame, or in a way that hides where they came from;
• use our name, logo or either service name as your own, in a way likely to confuse, or in advertising or metadata; or
• remove or obscure a copyright, trade mark or attribution notice.

Nothing on this website grants you any right in our intellectual property beyond the permission set out above.

5. Things you must not do

You must use this website lawfully, and not in a way that harms it or anyone else using it. In particular you must not:

• use an automated tool to scrape, harvest, index or bulk-download the site, except a search-engine crawler obeying our robots.txt;
• place a load on the site that interferes with its normal working;
• probe, scan or test the security of the website or attempt to defeat any protection on it;
• introduce a virus, worm, or any other harmful code;
• attempt to gain access to any part of the website, server or data that is not made public;
• impersonate us or anyone else, or misstate who you are or who you act for;
• use a contact channel on this site to send unsolicited marketing, or anything unlawful, abusive, defamatory or obscene; or
• collect personal information about other visitors.

We may withdraw access to the website from anyone who does these things, and report serious misuse to the appropriate authority.

6. Accuracy of what you read here

We take care over the content of this website and keep it under review. Even so, it is general information, and law, procedure, time limits and the practice of individual companies and forums all change.

We do not warrant that the content is complete, current or free of error, and we may change or remove anything on the website at any time without notice.

Any figures used to illustrate our fee are arithmetic, not a prediction. Where the website lets you enter an amount and shows what our fee would be on it, the amount is yours and the result is a calculation on it — it is not an estimate of what your case is worth, an offer, or a suggestion of any outcome.

No outcome is guaranteed. Nothing on this website should be read as a promise that a claim will be paid, a complaint upheld, or a matter resolved within any period.

7. What you send us through this website

When you use a form, write to us, or send documents, please send only what is accurate and what you are entitled to share. If a document concerns someone else, make sure you have their authority to send it.

How we handle personal data is set out in the Privacy Policy. What we do with a case you submit for review, and the confidentiality that applies to it, is set out in the Terms & Conditions for case submission.

Ideas, suggestions or feedback about the website itself that you send us unprompted may be used freely and without payment. This does not apply to your case papers or personal data, which are covered by the pages above.

Please do not send us anything highly sensitive by ordinary email, which is not a secure channel.

8. Links, embedded content and other websites

This website links to other websites, and uses a small number of third-party services — a hosted form for case submission, a service that supplies our Google reviews, and two analytics services that measure how the site is used. What each one collects is set out in our Privacy policy.

Those sites and services are not under our control. A link is not an endorsement, and we are not responsible for the content of another website, for its availability, or for what it does with information you give it. Their terms and privacy policies apply when you use them, not ours.

You may link to this website from your own, provided you do so fairly, without damaging our reputation or taking advantage of it, and without implying an association or approval that does not exist. We may ask you to remove a link, and if we do, you should remove it.

9. Reviews shown on this website

The customer reviews on this website are real reviews left on our Google Business Profile. They are shown as their authors wrote them. We do not write them, edit them, or pay for them, and the rating and review count shown come from Google rather than from us.

The reviews displayed may be filtered by rating, but the headline rating and the total review count always reflect every rating on the profile, including any not displayed.

A review describes one person's experience of their own matter. It is not a prediction about yours.

10. People misusing our name

We are aware that individuals have approached claimants and policyholders in our name and asked for money to resolve complaints. For case handling under Bima Samadhan we never ask for payment upfront — our fee is payable only after the case is successfully resolved.

Deal with us only through the contact channels published on this website. We are not responsible for anything done by a person who is not authorised to act for us, and we would be grateful to hear from you at care@samadhansarathi.in if you are approached.

11. The website is provided as it is

This website is made available free of charge, "as is" and "as available", for general information. To the fullest extent permitted by law we give no warranties, conditions or representations of any kind in relation to it, whether express or implied — including as to accuracy, completeness, currency, fitness for any particular purpose, merchantability, title, non-infringement, uninterrupted or error-free operation, or freedom from harmful code.

Your use of this website, and any reliance you place on anything published here, is entirely at your own risk. The content is general, it is not advice on your matter, and it is not a substitute for advice on your actual facts, documents and dates. If you choose to act on something you read here without taking advice, you do so on your own judgement and at your own cost.

We may change, suspend, restrict or withdraw the website or any part of it at any time without notice, and we are not liable for doing so.

12. Limit on our liability

This section is important. Please read it.

1. What this section covers. It governs our liability arising out of or in connection with this website — visiting it, relying on it, being unable to use it, or anything reached through it. Our liability for the services is dealt with in the terms for each service and, once signed, in your Service Agreement. Nothing on this page creates any liability in respect of a service.

2. Losses we are not liable for. To the fullest extent permitted by law, we are not liable to you or to anyone claiming through you, whether in contract, tort (including negligence), under statute or otherwise, for:

• indirect, incidental, special, consequential, exemplary or punitive loss of any kind;
• loss of profit, revenue, business, contracts, goodwill, reputation, anticipated savings or opportunity;
• loss or corruption of data;
• loss arising from your reliance on anything published on this website, or from anything you did or did not do on the strength of it;
• loss arising from a right, remedy, deadline or limitation period that was missed, expired or prejudiced;
• loss arising from the website being unavailable, interrupted, delayed, altered or withdrawn;
• loss arising from a virus, malicious code, unauthorised access, interception or security incident affecting your device or connection;
• loss arising from the content, availability or conduct of any other website, platform or third-party service reached from this one; or
• loss arising from the act, omission or default of any person who is not authorised to act for us, including anyone who uses our name, logo or either service name without our authority.

3. Overall cap. Subject to paragraph 5, our total aggregate liability in respect of all claims arising out of or in connection with this website, however arising and whether under one claim or several, shall not exceed ₹10,000 (rupees ten thousand) or the total amount (if any) you have actually paid us for use of this website, whichever is the lower. This website is provided free of charge, and that fact has been taken into account in setting this limit.

4. Information you give us. We are entitled to rely on what you tell us and on the documents you send. We are not liable for any loss, delay or consequence arising from information that is incomplete, inaccurate, out of date, withheld or misrepresented, from a document you were not entitled to send us, or from any impersonation of or misrepresentation as to your identity, authority or entitlement to act. A person who obtains anything from us by a false or misleading statement acquires no rights against us in respect of it.

5. Fair allocation. The limits in this section reflect the fact that the website is provided free, that its content is general, and that we have no control over how any reader uses it. You accept that they are reasonable.

13. Your responsibility to us

You agree to indemnify us, and to keep us indemnified, against any loss, liability, claim, demand, proceeding, penalty, damage, cost or expense (including reasonable legal costs) that we incur arising out of or in connection with:

• your use of this website in breach of these terms, or for any unlawful purpose;
• any information, document or statement you give us that is false, misleading, incomplete or given without the authority of the person it concerns;
• any impersonation or misrepresentation by you as to your identity, authority or entitlement to act;
• your infringement of our intellectual property or that of any third party; or
• any claim brought against us by a third party in consequence of any of the above.

We will notify you of any claim to which this section applies and will not settle it without first giving you a reasonable opportunity to respond. This section survives your ceasing to use the website.

14. If part of these terms cannot be enforced

If any part of these terms is found by a court to be unenforceable, that part is to be treated as removed and the rest continues to apply.

If we do not insist on something these terms entitle us to, or delay in doing so, that is not a waiver and does not prevent us from insisting on it later.

15. Changes to these terms

We may amend these terms from time to time — for example when the law changes, when the website changes, or to make something clearer. The current version is always the one on this page, and the date it was last revised is shown at the top.

Changes take effect when they are published here. Continuing to use the website after that means you accept the revised terms. Nothing published here changes the terms of a Service Agreement already signed.

16. If something on this website concerns you

If you have a complaint about this website — its content, something published about you, material you say infringes your rights, or misuse of our name — write to our Grievance Officer and we will look into it.

Please tell us who you are, how to reach you, what the concern is, and where on the website it appears. If you are claiming an infringement, please identify the material and the right you rely on. We acknowledge complaints and aim to resolve them as quickly as the matter allows.

17. Governing law, and where a dispute is decided

These terms, and any dispute arising out of the website or out of these terms, are governed by the laws of India.

Before commencing any proceedings, you agree to raise the matter with us in writing at care@samadhansarathi.in and to allow us thirty days to respond and attempt to resolve it. Many matters end there.

Subject to that, the courts at Ludhiana, Punjab shall have jurisdiction over any dispute arising out of or in connection with this website or these terms, and you submit to that jurisdiction. This does not prevent us from applying to any court for an injunction or other urgent relief to protect our intellectual property or to stop misuse of our name.
