Mis-selling

Wrong policy sold? Make a mis-selling complaint.

Last updated 23 October 2026.

The short answer. If an insurance policy was sold to you on wrong or misleading terms, including through a bank, write to the insurer describing what was said and what you were given, ask for a remedy, and escalate in order: the grievance officer, Bima Bharosa, then the Insurance Ombudsman. Check the free-look window printed in your policy papers.

Your options

Your options, in order.

Act early. A written record made soon after the sale is the strongest evidence.

  1. 1. Write down what happened. Who sold it, when, what was promised, and what you were told about premium, term and returns.
  2. 2. Read the policy papers. Compare the promise with the policy document and the benefit illustration. Note the free-look window stated in them.
  3. 3. Write to the insurer. Describe the mis-selling, attach the papers and state the remedy you want, such as cancellation and refund.
  4. 4. Escalate. To the grievance officer, then Bima Bharosa.
  5. Approach the Insurance Ombudsman. If the insurer has rejected your complaint, has not replied within a month, or the reply is not acceptable, you can complain to the Insurance Ombudsman within one year. There is no fee, and compensation sought should not exceed ₹50 lakh.

Documents to keep

  • Policy document and benefit illustration
  • Proposal form
  • Premium receipts and bank statements
  • Messages, emails or call details from the seller
  • Any brochure or promise you were shown
  • Every letter and reply

Typical situations

What mis-selling can look like.

These are examples, not a test of whether you have a complaint.

  • A policy described as something else. For example an insurance plan presented as a savings or fixed-deposit product.
  • A bank-sold policy. A policy sold at a bank branch to a customer who asked for another product.
  • Wrong details in the form. Answers entered in the proposal form that you did not give.
  • Premium terms not explained. Premium-paying term or lock-in not made clear.

Questions

Common questions.

I was sold a policy I did not ask for. What can I do?

Write down what happened, write to the insurer with your papers, and escalate to the grievance officer, Bima Bharosa and the Insurance Ombudsman.

What about a policy sold by my bank?

The complaint about the policy is made to the insurer and then the same ladder applies. Keep the bank’s communication as evidence.

What is the free-look period?

It is a window after you receive the policy in which you can return it. The length is stated in your policy papers, so check them.

How do I document a mis-selling complaint?

Note who, when and what was promised, and keep the policy papers, receipts, messages and brochure.

Is there a fee for the Ombudsman?

No. There is no fee, and compensation sought should not exceed ₹50 lakh.

Will Samadhan Sarathi get my money back?
